AI Terms

Effective date: October 13, 2026

1. Acceptance of These Terms

These AI Supplemental Terms supplement the agreement governing your use of G360’s services (“Terms and Conditions”) and are incorporated in by reference. “AI Features” means functionality incorporating artificial intelligence, machine learning, automated transcription, or similar technologies. Depending on the G360 services utilized, AI Features may assist with summarizing assessment responses, identifying feedback themes, drafting development plans, recommending learning activities, and providing feedback on coaching or practice exercises. “Users” includes learners, assessment subjects, raters, coaches, and other authorized users.

2. AI limitations and accuracy

AI-generated summaries, transcripts, observations, recommendations, scores, and other content (“AI Output”) may be inaccurate, incomplete, misleading, inconsistent, or biased, even when expressed confidently. AI Features may misinterpret statements, omit relevant context, attribute statements incorrectly, or generate conclusions unsupported by the underlying information. Speech recognition and analysis may be affected by accents, language differences, disabilities, background noise, and recording quality.

AI Output does not independently establish the truth of a statement about a User, the cause of a behavior, or a User’s competence, intentions, personality, or future performance. Research supporting a G360 assessment instrument does not, by itself, establish the validity or reliability of AI-generated interpretations, recommendations, or modifications.

3. Human review and appropriate reliance

AI Features support learning, reflection, and professional development. Organizational Sponsors and Users must exercise independent judgment and review material AI Output against available source information before relying on or distributing it, subject to applicable confidentiality and access restrictions.

AI Output is not a substitute for qualified human coaching, professional advice, or an independent assessment of relevant circumstances. G360 does not guarantee any particular learning, leadership, employment, or business outcome.

4. Restrictions on Uses

Organizational Sponsors and Users must not use AI Output to make or materially support decisions about hiring, promotion, compensation, discipline, termination, or other consequential employment actions.

Furthermore, Organizational Sponsors and Users agree not to use any AI Features to (a) develop, train, fine-tune, benchmark, or evaluate any competing or third-party AI or machine-learning model; (b) input confidential, personal, sensitive, or third-party information that you are not authorized to disclose; (c) generate unlawful, infringing, harmful, deceptive, or discriminatory content; or (d) reverse engineer, extract, or misappropriate any underlying models, prompts, weights, or proprietary technology.

5. Information submitted to AI Features

“User Content” includes prompts, survey responses, messages, uploaded materials, recordings, transcripts, and other information submitted to or captured through AI Features.

Organizational Sponsors and Users may submit only information they are authorized to provide and that is reasonably necessary for the intended activity. Users should use hypothetical examples and remove names and identifying details from workplace scenarios whenever practicable.

Except where G360 expressly authorizes a specific category of information in writing and appropriate safeguards are in place, Users must not submit:

(a)   trade secrets, nonpublic business strategies, proprietary source code, confidential customer materials, or other confidential employer or third-party information;

(b)   personal information, such as passwords, access credentials, government identification numbers, financial account or payment-card information, medical information, disability records, biometric identifiers, or other statutorily protected information; or

(d)   attorney-client privileged communications, personnel investigation materials, or information subject to legal or contractual restrictions that prohibit sharing of information with third parties.

Ordinary business contact information and assessment responses expressly requested by G360 may be provided for their intended purpose, subject to applicable notices and permissions.

6. Authorization and confidentiality

User is responsible for its authority to provide the supplied information to G360 in order for G360 to process it. Users must not upload another person’s recording, private communications, or confidential information without the necessary authorization and any legally required consent.

Submission of information does not transfer ownership of that information to G360. These submission restrictions do not excuse G360 from its applicable legal obligations. An Organizational Sponsor and Users should promptly notify G360 at support@g360surveys.com if restricted information is submitted inadvertently.

7. Recording, transcription, and automated analysis

Where an enabled feature captures voice or other session content, G360 will provide a notice before capture begins.

Recording or transcription will begin only after the required notices and consents have been provided or obtained. Participants must not include another person in a recorded interaction without that person receiving the required notice and providing any required consent. Participants may stop further capture using the available controls or by leaving the feature. Stopping capture does not automatically delete information already collected.

8. Technology providers and permitted processing

G360 uses third-party providers to supply AI models, speech recognition, hosting, storage, and related functionality. G360 may transmit User Content to those providers only as necessary for the disclosed purposes and subject to applicable contractual and legal safeguards.

If a feature requires a User to establish a separate account or contract directly with an independent provider, G360 will identify that requirement before the User elects to use the feature.

9. Model training

G360 will not use, or permit its providers to use, User Content or identifiable AI Output to train or fine-tune general-purpose or shared AI models.

10. Output rights

As between G360 and Customer, and to the extent permitted by law, an Organizational Sponsor may use AI Output generated for User’s authorized internal training and development purposes, subject to User’s rights, third-party rights, and the Terms and Conditions. G360 retains all rights in its platform, assessment instruments, methodologies, and preexisting materials.

AI Output may not be unique or eligible for intellectual property protection. G360 does not guarantee that AI Output will be free of third-party rights. User should review AI Output before external publication or incorporation into other materials.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXCEPT FOR EXPRESS COMMITMENTS IN THE AGREEMENT OR THESE TERMS, G360 PROVIDES THE AI FEATURES AND AI OUTPUT “AS IS” AND “AS AVAILABLE” AND DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. G360 DOES NOT WARRANT THAT AI OUTPUT WILL BE ERROR-FREE, COMPLETE, UNBIASED, OR SUITABLE FOR A PARTICULAR DECISION.

12. Limitation of liability

To the maximum extent permitted by law, claims arising from or relating to AI Features or AI Output are subject to the exclusions of damages, aggregate liability cap, and applicable exceptions stated in Section 18 of the Terms. Those limitations apply across the services collectively and do not create a separate or additional liability cap for AI Features.

Nothing in these terms expands a liability exclusion to a claim excluded from that limitation under the Terms, or excludes or limits liability that applicable law does not permit to be excluded or limited.
